General terms and conditions of sale
1. Identification of the seller
These Terms and Conditions are those of ATELOR (trading under the name LORNET), whose registered office is located at 45 AVENUE CORIANDRE 13600 LA CIOTAT, FRANCE, registered in the trade register under SIRET number: 98479366100013.

2. Scope and acceptance of the GTC
These General Terms and Conditions of Sale (GTC) apply to all sales of watchmaking products and services made by LORNET to private customers (non-professionals) by telephone, at private sales, in person, or on the Internet. These GTC govern all commercial relations between LORNET and the customer.
The customer acknowledges having read these GTC and accepts them without reservation before placing an order. LORNET reserves the right to modify these GTC at any time. The modifications will take effect as soon as they are published on the website or on the date of communication to the customer, and will apply to all new orders.
The version of the GTC in force at the time of the order will prevail over any other previous or specific conditions.
3. Products and Services
LORNET offers watches, watch accessories, and repair and maintenance services for sale. The characteristics of the products and services are detailed on our website and are subject to change without notice.
For customizable products, we may request a deposit when the order is placed. Customized products cannot be returned.
3.1. Refusal or blocking of the order by the Seller
In the event of a problem or dispute arising from a previous order, the seller reserves the right to block the customer's order until the problem is resolved.
The seller may also refuse or cancel an order in the following situations:
The customer's bank details are unusable (incorrect or unverifiable).
Payment has been refused by the customer's bank or has not been made within the specified time frame.
The delivery address provided by the customer is incorrect or does not exist.
The customer is presumed to be unable to enter into a contract or to be ordering for purposes other than strictly personal use.
The price indicated contained an obvious error.
The order is identified by security systems as unusual or likely to be fraudulent.
The customer has violated these General Terms and Conditions of Sale.
Or for any other legitimate reason.
The seller may then carry out additional checks and ask the customer for the documents or information necessary for the proper execution of their order. The seller cannot be held liable for any damage or costs incurred as a result of this refusal or blocking of the order.
3.2. Product availability
Orders are only fulfilled while stocks last. Product offers and prices are valid as long as they are visible on the website when the customer places an order, while stocks last. If a product is unavailable after the customer has placed an order, the seller will inform the customer by email as soon as possible. The order amount will be recalculated and the customer will be refunded for the value of the unavailable products, or for the total amount of the order if it is entirely unavailable, no later than 60 days after payment of the sums paid by the customer. Cancellation of the order by the seller in the event of product unavailability will not entitle the customer to any compensation. In the event of a product being unavailable, the seller may supply a product of equivalent quality and price if the customer agrees. In this case, the return costs resulting from the exercise of the right of withdrawal relating to the substituted product shall be borne by the seller.
4. Prices and Payment
Prices are quoted in euros, inclusive of all taxes (VAT included), excluding delivery costs. Payment can be made by credit card, bank transfer, or any other payment method offered at the time of ordering. Payment must be made prior to delivery.
4.1. Currencies
For European Union territories to which the seller agrees to deliver products, orders are payable in euros (€). If the customer's local currency differs from the currency in which prices appear on the website, the customer's bank will apply the exchange rate in effect on the date of the order (unless a different exchange rate is applied at the discretion of the customer's bank). Consequently, changing the country of delivery may alter the price of the products due to the change in currency.
5. Ordering and Confirmation
5.1. Telephone orders
Orders will be taken in French or English by our Customer Service department on +33 (0)4 42 83 91 90 (local call rate) from mainland France, Monday to Saturday, 9:30 a.m. to 8:00 p.m., and Sunday, 9:30 a.m. to 5:30 p.m., except on public holidays.
5.2. Internet orders
Orders can be placed on our online store, accessible from the English version of our website. Customers are responsible for any telecommunication costs incurred when accessing the Internet and using the website.
The photographs, graphics, and descriptions of the products offered for sale are for illustrative purposes only and are not binding on LORNET. Customers can obtain additional information by contacting our Customer Service department by telephone.
LORNET cannot be held liable for any obvious errors between the characteristics of the items and their representation.
The customer must complete an order form, specifying certain mandatory fields, in order for their selection to be taken into account.
In the event of prolonged inactivity during the connection, it is possible that the selection of items chosen before this inactivity can no longer be guaranteed. The customer will be asked to restart their product selection from the beginning.
All the steps necessary for the sale will be specified on the website in accordance with Article 1369-1 of the Civil Code. Before finally confirming their order, customers will have the opportunity to check the details of their order and its total price and to correct any errors before confirming their acceptance. Once the customer has confirmed their order, LORNET will acknowledge receipt of the order immediately by electronic means.
However, the sale will only be considered final after LORNET has sent the customer an order confirmation specifying the shipment of the items.
6. Delivery
Items can be delivered worldwide. Delivery is made to the address specified by the customer when placing the order. Delivery costs are borne by the customer.
Items will be delivered after payment for the order has been received. In accordance with the provisions of the Consumer Code, the items ordered will be delivered within the time frame communicated by LORNET and, if no time frame is specified, in any event no later than 120 days from the date of the order, subject to full payment of the price. Any delivery times communicated by LORNET are for information purposes only.
If, upon delivery, the exterior of the package is not in perfect condition, the customer must open it in the presence of the carrier in order to check the condition of the item. In the event of damage to the item, the customer must detail this precisely on the delivery note, with the provisions of Article 11 below remaining applicable.
Customers also have the option of collecting items from our workshops or benefiting from hand delivery.
7. Right of withdrawal
The customer has a legal right of withdrawal which they may exercise within 14 days of receiving the goods, under the conditions set out in Articles L. 221-18 and L. 221-20 of the French Consumer Code, if they meet the conditions set out in these provisions, without having to justify their decision or pay any penalties.
The customer has 14 days from receipt of the products to exercise their right of withdrawal. Products must be returned in their original condition with all their accessories. Return shipping costs are the responsibility of the customer, except in the event of an error on our part. Personalized products cannot be returned.
8. Refund
Refunds for returned items will be made within four (4) months of the date on which the customer notified LORNET of their withdrawal (or within four (4) months of LORNET receiving the items, if the customer chooses to return the items by post rather than using the collection service).
The refund will be made, depending on the method of payment for the items, by crediting the customer's bank account corresponding to the credit card used for payment or by transfer to the customer's bank account. In accordance with Article L.221-24 of the French Consumer Code, any additional costs paid by the customer and related to the choice of a specific delivery method will not be refunded.
9. Conformity of items
The customer must ensure that the items delivered to them correspond to their order. In the event that the items delivered do not conform to their order, the customer must inform our Customer Service department by telephone and return the items in question in accordance with the conditions set out in Article 8 of these General Terms and Conditions of Sale.
10. Intellectual Property
The LORNET trademarks, as well as all illustrations, images, logos, visual and/or textual elements appearing on the website, products, their accessories and packaging, and more generally all distinctive signs, are and remain the exclusive property of LORNET. Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, visual and/or textual elements, for any reason and on any medium whatsoever, without the express prior consent of LORNET is strictly prohibited. The same applies to any combination or conjunction with any other trademark, symbol, logo and, more generally, any other distinctive sign. The same applies to any copyright, design, model and patent which are and remain the property of LORNET.
11. After-Sales Service (SAV)
LORNET offers an after-sales service for its products. For any information, complaints, or questions relating to the Terms and Conditions of Sale by Mail Order established by LORNET or to the items themselves, customers should contact Customer Service at +33. (0)4.42.83.91.90 (price of a local call), or via the website using the “Contact us by email” form, quoting their order number if applicable.
11.1 Commercial warranty
The commercial warranty applies in the context of normal use of the product and covers all repair and maintenance services for the goods sold by LORNET to the buyer. This includes parts and labor, excluding services related to wear and tear and aging of the product.
Defects or breakdowns in products resulting from abnormal use of the product, from a cause external to the product (e.g., an accident, impact, or immersion), from use of the product that does not comply with the instructions provided to the buyer, or from intervention by a repairer not approved by LORNET are not covered by the commercial warranty.
In the event of a problem arising during normal use of the product within the commercial warranty period, the customer may return the product with a brief description of the problem. Our intervention will be free of charge if it is found that the problem is indeed the result of normal use of the purchased product. The costs and risks of transport are the responsibility of the buyer.
To protect the item, it is advisable to place it in suitable cardboard packaging and send it to ATELOR SAS, 45 Avenue de Coriandre, 13600 La Ciotat, France, accompanied by the invoice. The faulty product can only be returned by registered parcel with acknowledgment of receipt.
In accordance with Article L. 211-16 of the French Consumer Code, "when the buyer asks the seller, during the commercial warranty period granted to them at the time of purchase or repair of a movable item, for a repair covered by the warranty, any period of immobilization of at least seven days shall be added to the remaining warranty period. This period shall run from the date of the buyer's request for intervention or from the date on which the goods in question are made available for repair, if such availability is subsequent to the request for intervention."
The period during which or the date until which spare parts essential for the use of the goods are available on the market will be brought to the buyer's attention before and at the time of conclusion of the sales contract.
Services provided under the commercial warranty are guaranteed for a period of six months from the date of return of the product to the buyer. The product will be returned to the buyer at LORNET's expense.
If the product under warranty proves impossible to repair, LORNET undertakes to replace it with a similar product of equivalent value.
11.2. Repairs not covered by warranty
In the event of a request for repair of a product whose warranty has expired, LORNET will provide the customer with a quote.
12. Force Majeure
The performance by LORNET of all or part of its obligations shall be suspended in the event of a fortuitous event or force majeure that would hinder or delay performance.
Such events include, but are not limited to, war, riots, insurrection, social unrest, strikes of any kind, and supply problems affecting LORNET.
LORNET shall inform the customer of any such unforeseeable circumstances or force majeure within seven (7) days of their occurrence. If this suspension continues beyond a period of fifteen (15) days, the customer shall then have the option of canceling the order in progress, and a refund shall be made in accordance with the conditions set out in Article 8 of these General Terms and Conditions of Sale.
13. Limitation of liability
LORNET cannot be held liable for indirect damage, operating losses, or any other damage resulting from the use of the products beyond their normal use.
14. Personal data
The customer's personal data is collected solely for the purpose of order management and will not be shared with third parties without the customer's consent. The customer has the right to access, rectify, and delete their personal data.
15. Applicable law and disputes
These T&Cs are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. If no agreement can be reached, the competent court will be that of Marseille.
